1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you and ChallenThem (“ChallenThem”, “we”, “us”, or “our”). By accessing or using our websites, games, chats, or related services (collectively, the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility & Regional Availability

You represent that you (a) are of legal age to form a binding contract where you live, and (b) are not prohibited from using the Services under applicable laws (e.g., sanctions, local skill-gaming or prize restrictions). Some features—such as prizes, crypto or fiat rewards—may be unavailable or limited in certain jurisdictions and at certain times.

3. Accounts, Security & Access

You are responsible for your account credentials and all activity under your account. Keep your login secure and notify us immediately of any unauthorized use. We may offer single-sign-on, device-based sessions, or additional verification to protect competitive integrity. We may suspend or terminate access for risk, abuse, inactivity, or policy violations.

4. Gameplay, Fair Play & Anti-Cheat

• Skill-based play. Matches typically last ~15 seconds; outcomes depend on skill (e.g., reaction time, accuracy, puzzle performance).
• Integrity. We may use anti-cheat, anomaly detection, device checks, moderation, and manual review.
• Strictly prohibited. Bots, macros, emulators (unless expressly allowed), tampering, manipulating latency, collusion, score spoofing, multi-account abuse, or exploiting bugs.
• Consequences. We may invalidate results, remove rewards, apply penalties, restrict features, or suspend/terminate accounts.
• Finality. Except for clear system errors verified by us, match outcomes and leaderboard decisions are final.

5. Virtual Credits

ChallenThem may provide virtual “credits” for play, testing or rewards. Credits are not money, have no cash value, and are non-transferable except as we expressly permit. We may grant, deduct, cap, expire, or reset credits at our discretion (e.g., monthly balance resets, anti-abuse protections). Promos and grants may vary by region and account history.

6. $CHEM Utility

$CHEM is a platform utility that may confer access, boosts, cosmetics, voting and other features inside ChallenThem. $CHEM is not legal tender. Utility, availability and eligibility may vary by region and account standing. We may modify or discontinue specific utilities, balances, or mechanics to maintain fairness, compliance and security.

7. Fiat Payments & Payouts (Where Available)

Where permitted, you may be able to purchase entries, buy credits, or cash-out rewards via supported payment providers. Fees, limits, KYC/AML checks, fraud screening, and regional rules may apply. Availability is not guaranteed and may be paused or revoked at any time. Upcoming: fiat options may roll out gradually.

8. User Content & Licensing

You retain ownership of content you submit (e.g., chat messages, highlights). You grant ChallenThem a worldwide, non-exclusive, sublicensable, royalty-free license to host, use, reproduce, adapt, publish, display and distribute your content to operate, promote and improve the Services. You must have the rights to everything you upload and you are responsible for it.

9. Prohibited Conduct

• Cheating, reverse-engineering, scraping or interfering with the Services.
• Harassment, hate, doxxing, spam, or illegal content/activity.
• Commercial use without permission, trademark misuse, or misleading impersonation.
• Uploading malware, exploiting vulnerabilities, or breaking access controls.

10. Moderation, Enforcement & Remedies

We may remove content, restrict features, invalidate results, claw back rewards, or suspend/terminate accounts to protect users and integrity. We may investigate suspected abuse and cooperate with law enforcement where required.

11. Disclaimers; Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHALLENTHEM DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CHALLENTHEM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES; OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) IN THE 6 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

12. Indemnity

You will defend, indemnify and hold harmless ChallenThem and its affiliates from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to your content, your use of the Services, or your violation of these Terms or applicable law.

13. Governing Law; Dispute Resolution

Unless prohibited by local law, these Terms are governed by the laws of our principal place of business, without regard to conflict-of-laws rules. Except where prohibited, disputes will be resolved by binding individual arbitration and you waive class actions and jury trials. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in court for IP or security matters. If mandatory consumer laws in your country require different dispute mechanisms, those laws will prevail for you.

14. Changes; Termination; Miscellaneous

• Changes. We may update these Terms; continued use means acceptance. Material changes will be signaled by updating the “Updated” date above.
• Termination. We may suspend or terminate the Services or your access at any time; you may stop using the Services at any time.
• Severability. If a provision is unenforceable, the rest remains in effect.
• Assignment. We may assign these Terms; you may not without our consent.
• Entire Agreement. These Terms + referenced policies comprise the entire agreement between you and ChallenThem.
